Terms and Conditions for Arbor by Botany Labs, Inc.
1. Service Description
Arbor is an AI-powered phone line service provided by Botany Labs, Inc. We offer a dashboard for users to configure AI behavior and provide phone numbers (on paid plans) connected to the configured AI. Users can build their AI configurations for free, but hosting on a phone number incurs charges.
2. User Eligibility
Arbor's services are primarily designed for small business owners. There are no specific age restrictions for using the service.
3. Data Collection and Use
We collect user email addresses and any information provided to create the AI bot. This data is used solely to provide the AI phone service. We do not perform analysis on the content provided or sell this data to third parties.
4. Data Security
User data is encrypted at rest using AES-256 encryption and transmitted over TLS. We implement strong authentication schemes to ensure user data privacy.
5. Acceptable Use
While we do not impose specific limitations on service usage, we prohibit use by illicit businesses or for intentionally malicious or fraudulent purposes. We reserve the right to refuse service to any user or business that violates these terms.
6. Subscription and Cancellation
Arbor is primarily sold as a monthly subscription. Upon cancellation, users retain access to the product until the end of the current billing cycle. For refund inquiries, please contact our customer service team.
7. Disclaimer of Warranties and Limitation of Liability
Arbor is provided “as is” without any warranties, express or implied. Botany Labs, Inc. will not be held responsible for any harm, damage, or loss of business resulting from the use of Arbor. Users acknowledge that AI is a novel technology with inherent quirks and accept the associated risks of using such technology in their business operations.
8. Intellectual Property
Users retain the intellectual property rights to the specific Arbor configurations they create. Botany Labs, Inc. cannot sell or license user-created configurations without explicit consent from the user. However, Botany Labs, Inc. reserves the right to use user-generated content to inform improvements to the Arbor service.
9. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United States. Botany Labs, Inc. is a C Corporation registered in Delaware, and any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
10. Service Level Agreement (SLA)
Botany Labs, Inc. commits to resolving service issues within 24 hours. If this SLA is not met, users are entitled to a refund for that day of service.
11. Modifications to Terms and Service
Botany Labs, Inc. reserves the right to modify these Terms and Conditions or the Arbor service at any time without notice. Continued use of Arbor after such modifications constitutes acceptance of the updated Terms and Conditions or service changes.
12. Termination
Botany Labs, Inc. reserves the right to terminate a user's account for any reason deemed necessary. In the event of termination, the user will receive a refund for any unused portion of their paid service.
13. User Obligations
Users are prohibited from reverse engineering the Arbor software. Users are also strictly prohibited from using Arbor for spam or any unsolicited mass communication purposes. Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.
14. Changes to Terms and Conditions
Botany Labs, Inc. reserves the right to modify these Terms and Conditions at any time. Users will be notified of any changes, and continued use of Arbor after such modifications constitutes acceptance of the updated Terms and Conditions.
